Delivery and Returns Policy
This Policy sets out Sportsforce Pty Ltd ACN 606 955 417, ABN 73 606 955 417’s policy in respect of delivery and returns, trading as Gunforce.
Unless the context requires otherwise, terms used in this Policy have the definition provided for such terms in the Terms and Conditions which can be found at www.gunforce.com.au.
Costs of Delivery
The costs of delivery of a Product are payable in addition to the price of the Product. You must pay the costs of delivery at the time you place an Order or at another time notified by us.
We will use our best endeavours to complete the processing, postage and delivery of your Order within the timeframe specified by us. However, given the nature of deliveries, any delivery times stated by us are estimates only and are non-binding.
You are required to pay any duties or taxes which attach to the supply and delivery of your Order, including but not limited to customs duties, at the same time as you pay for the Product or otherwise at the time specified by us.
Delivery and Licences
You acknowledge and agree that due to the nature of certain Products, they may not be delivered directly to your nominated address such as a PO Box or private residential address (“Home Address”). Instead, the Product may be made available for collection at an address nominated by us (“Collection Address”).
This requirement applies to airguns, shotguns, firearms and any other Products we determine at our discretion.
When you place your Order, we will notify you as soon as possible where the Product will be delivered and when it will be available for collection. Delivery and collection dates are estimates only and may change.
You warrant that at the time of placing your Order you hold all necessary identification, licences and certificates required by law or any authority (“Licences”) in order to own the Product in the delivery or collection location.
At the time of delivery or collection of your Order you must present all Licences and other information requested by us or our delivery agent. You must also complete any forms required by us or our delivery agent.
You warrant that all information including Licences provided to us are true and correct and have not been fraudulently obtained. We reserve the right to reject any Licences provided if we determine they are not genuine or have expired.
You authorise us to undertake any investigations we consider necessary to determine whether the information provided is genuine. During such investigations you authorise us to disclose your personal information to third parties for verification purposes.
If you are unable to comply with these requirements, we reserve the right at our discretion to refuse supply of the Products you have ordered and cancel your Order. In such circumstances no refund may be payable and you may be required to pay the costs of returning the Products to us.
Risk and Title
All fully paid Orders will be shipped by the carrier nominated by us. Until an Order is paid for in full, title in the relevant Product remains with Gunforce.
If an item you purchase is to be delivered by Gunforce, the risk in the item will pass to you:
- In the case of delivery to a Collection Address, when the Product is delivered to that address.
- In the case of delivery to your Home Address, when delivery is first attempted if we are unable to deliver the item for any reason.
If we attempt to deliver your Order to your Home Address and you are not present to accept the delivery, we may leave the Product at the address or retain the Product and attempt re-delivery. Any storage or re-delivery costs must be paid prior to re-delivery.
If we deliver your Order to a Collection Address and you do not collect it within the timeframe specified, the Order may be returned to us. In that case you must contact us to arrange re-delivery or collection and pay any applicable return, storage and re-delivery costs.
Returns
General
If you wish to return a Product you must contact us and complete any forms provided by us.
You must follow all instructions provided by us regarding the return process. This may include returning the Product to a Collection Address.
When returning a Product you must include your original invoice or receipt, any required documentation and ensure the Product is packaged safely and securely.
Defects
All defects are handled in accordance with the warranty provisions outlined on our website and within our Terms and Conditions.
If you believe a Product is defective you must notify us as soon as possible and provide all information and evidence requested by us.
Return Process
If you wish to return a Product you must contact us and complete any forms provided by us.
You must follow all directions provided by us regarding the return process. This may include returning the Product to a Collection Address and providing the original invoice and required documentation.
Cost of Return
You may incur costs when returning a Product including freight or postage charges. Gunforce is not responsible for these return costs unless we determine the Product is defective.
If a Product is confirmed as defective we may reimburse reasonable return shipping costs upon receipt of proof of those costs.
You are responsible for the risk of the Product while it is being returned to us. If a returned Product is lost in transit we cannot provide a refund or exchange. For this reason we recommend using registered or insured shipping when returning Products.
